A summary, not the agreement

  • You contract with your clients for the services you perform. Bokful is the software you run those bookings on.
  • Your client list, services and booking history are yours. There is no export button yet: ask us and we send you a file, including on the day you leave.
  • For your client records you are the controller and Bokful is your processor, acting on your instructions only.
  • Bokful charges no commission and no per-booking fee today. What plans will cost lives on the Pricing page.
  • Bokful takes no payments: your clients pay you directly, and no client money passes through Bokful.

What this agreement covers

This is the agreement between Bokful and a business that takes bookings through it. Your clients are covered by the customer Terms.

By publishing a page on Bokful you agree to these terms. They sit alongside the Privacy Policy. If Bokful ever adds payment processing, that provider’s own terms would join them, and you would be told before they applied to you.

1.1

You contract with your clients for the services you perform. Bokful is the software you run those bookings on.

1.2

Bokful takes no money from your clients and has no means to. You collect payment directly, in full, at the appointment.

What you are responsible for

Accurate prices and availability, bookings honoured, and every licence the work requires.
  • Accuracy: prices, durations, taxes, staff and opening hours on your page are correct and current.
  • Honouring bookings: a confirmed booking is kept, or the client is told promptly and offered an alternative.
  • Lawful trading: you hold the licences, qualifications, insurance and permissions your services require, and you meet the consumer, health and safety, and tax rules of your market.
  • Your people: staff you add act under your instruction, and you are responsible for what they do in your account.
  • Your policies: a cancellation notice period applies only if it was published before the client booked, and anything you charge under it you collect yourself.
  • Client data: you handle the client data you receive through Bokful lawfully, and you use it to serve the appointment rather than to market without consent.

Fees

What Bokful charges is set out on the Pricing page, in one place only, so it cannot disagree with itself. Today it charges nothing.

Bokful takes no commission on a booking, charges no per-booking fee and takes no deposit fee. There is no subscription to pay while your city is opening, and no card is asked for. What each plan will cost when charging begins is published on the Pricing page and nowhere else, including here.

3.1

When there are fees, they are invoiced as described on the Pricing page, with a statement you can reconcile. Nothing can be deducted from client money, because no client money passes through Bokful.

3.2

A change to what you pay is notified before it takes effect, and a change that materially affects you is sent to you by email first.

3.3

Taxes on Bokful’s fees would be stated separately, per market. Taxes on the services you sell are yours to charge, collect and account for.

Taking money: what happens today

Your clients pay you directly. Bokful has no payment provider, holds no client money, makes no payouts and processes no refunds.
4.1

There is no deposit, card payment, refund or payout function in the product, and no column in the database behind one. Every payment for a service is settled between you and your client, and no client money reaches Bokful.

4.2

Because nothing passes through Bokful there is nothing to schedule out to you and no chargeback to pass on. Refunds are yours to decide and yours to give.

4.3

Taking payment through Bokful does not exist and is not part of this agreement. If it is ever built, this section is replaced and the new terms are put to you before you could switch anything on.

Client data, and who controls what

Your client list is yours. For that data Bokful acts on your instructions, not its own.

Two roles run in parallel, and confusing them is the most common mistake in a document like this:

5.1

For the client records, notes and history you build up in your account, you are the controller and Bokful is your processor: we process that data to run the platform, on your instruction, and for nothing else.

5.2

For platform accounts, security, fraud prevention and our own billing, Bokful is the controller.

5.3

You must have a lawful basis for the client data you enter, and you must tell your clients what you do with it.

5.4

Bokful does not sell your client list, does not market to your clients as if they were ours, and does not hand your list to another business.

5.5

Your client list, services and booking history are yours. There is no export button in the product today: ask us at partners@bokful.com and we send you what we hold in a usable file, including on the day you leave. The right does not wait for the button.

Reviews

There are no reviews on Bokful, so nothing here can be written about you by a client.

Bokful has no review, rating or public comment feature, and no business has a score on this platform. If reviews are ever added, these terms are changed and published before the first one can be left, and the rules will be visible before you are subject to them.

Suspension

A page can be restricted for false availability, unhonoured bookings or unlawful trading, with a reason and a route back.

Where we restrict or suspend a page we tell you why, we tell you what would resolve it, and bookings already taken are worked through rather than cancelled without notice.

Term, ending it, and leaving

Either side can end this with notice. Your data leaves with you.
8.1

You may close your business page at any time, subject to honouring bookings already taken.

8.2

Bokful may end this agreement on reasonable notice, or immediately for a serious breach or where the law requires.

8.3

On ending, ask us and we send you your data. We keep only what a tax, consumer-protection or safety rule requires us to keep.

Liability between us

Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything the law does not allow to be limited.
9.1

Bokful’s liability to you in any twelve-month period is limited to the fees you paid Bokful in that period, except for the matters in the summary above. While Bokful charges nothing, that figure is nil, which is the plain consequence of a free product and is stated rather than hidden.

9.2

Neither side is liable for loss of profit or goodwill that it could not reasonably have foreseen.

9.3

You indemnify Bokful against claims arising from the services you perform, from your staff and premises, and from client data you entered unlawfully.

10

Intellectual property and acceptable use

This section is not a draft. It binds your business in full from the day you publish a page, beta or not: the platform is ours, your content stays yours, and building a copy of Bokful from the inside is not something an account entitles you to.

Bokful and its licensors own all intellectual property in the platform: the software and its source, the design system, the interface and its layouts, the copy, the brand, the names and the marks, the data structures and the documentation. Nothing in these terms transfers any of it to you, and taking bookings through Bokful creates no right in it.

You are given a limited, revocable, non-exclusive and non-transferable licence to use Bokful for one purpose: taking and managing bookings for your own business. Anything outside that purpose is outside the licence.

10.1

You may not copy, reproduce, imitate, adapt, translate, decompile, disassemble or reverse engineer any part of the platform or its interface, and you may not create a derivative of it, whether for your own business or for anyone else.

10.2

You may not scrape the platform or systematically extract its data, listings or content, including another business’s page, by hand or by machine, and you may not access it with an automated tool, a crawler or a script without our written permission.

10.3

You may not use Bokful, including a trial account, a beta account or an account opened for the purpose, to build, train, benchmark or inform a competing product or service, whether you build it yourself or for someone else.

10.4

You may not circumvent, disable or probe any access control, rate limit or security measure, and you may not resell, sublicense, rent, lend or white-label your access.

10.5

You may not remove, obscure or alter any notice of ownership, authorship, trade mark or licensing anywhere on the platform or in anything you are given access to through it.

10.6

Opening or keeping an account in order to study, copy or replicate the platform is a material breach of these terms, whatever else that account is used for.

10.7

Where this section is breached we may suspend or close the account and the business page immediately and without notice, and we reserve every remedy available at law, including injunctive relief and a claim for damages and for our costs.

10.8

This section survives the ending of this agreement, by either side, and it applies to anything you took from the platform while you had access to it.

10.9

Your own content stays yours: your business name, your photographs, your service descriptions and your client records. You grant Bokful only the licence it needs to display them on the platform and to run the service for you, and that licence ends when you take the content down, except for copies we must keep by law.

10.10

If you send us feedback or an idea about the product, we may use it to improve Bokful without owing you anything for it and without it giving you any claim on what we build.

11

Confidentiality, and each side’s brand

We keep your commercial information confidential; each of us uses the other’s name only as agreed.
11.1

Neither side discloses the other’s non-public commercial information, except where the law requires.

11.2

You may say you take bookings on Bokful and use our mark as published in our brand guidance. We name you as a business on Bokful, and we ask before using you as a case study.

Governing law

Determined by where your business is established.
Malaysia

A business established in Malaysia contracts under Malaysian law, with the Malaysian courts having jurisdiction.

Poland

A business established in Poland contracts under Polish law, with the Polish courts having jurisdiction.

Qatar

A business established in Qatar contracts under Qatari law, with the Qatari courts having jurisdiction. Bokful has not opened a city in Qatar yet, so no business trades under this row today.
